By using this web site or our services, you agree acceptance of our terms, as well as your waiver of any claims against Subliminal Web Design or its contractors arising out of your use of our services or this web site. You accept that any information offered within this web site is advisory and that Subliminal Web Design accepts no responsibility for its accuracy. Any information offered throughout this web site may change from time to time. We make no representation, warranty or claim that any information available within this web site is up to date or accurate. Subliminal Web Design reserves the right to change its prices and Terms and Conditions without prior notice.
Custom web site design and Search Engine Optimisation (SEO):
Any quotation given for custom web site design with SEO will be
valid for a period of 30 days from the date of submission. A non-refundable
30% deposit will become due on acceptance of our quotation and
shall be paid before any further work commences. The remaining 70% will
become due on completion of your web site. Any amounts owed shall
be paid by the dates/times stated on the invoices. Late payment may incur a
surcharge of 3% per service. Non payment after 30 days will entitle Subliminal Web Design to terminate the contract and/or remove
your web site from our servers. Any paid deposits shall not be refunded.
We can provide a search engine optimisation and submission service for any client
utilizing our custom web site design services. Search Engine Optimisation and Submission is not made available as a stand alone service, it is made available only as an option with a custom web site design package.
Subliminal Web Design makes no guarantees
of ongoing/future performance of our client web sites and cannot be held
responsible for any sudden drop in traffic or search engine page ranking.
All web sites are designed to be compatible with Microsoft Internet Explorer
5 and above but may also be compatible with earlier browser versions. Our web sites are also compatible with Netscape, Firefox and
Opera, however some features may not always be supported by these
browsers. All web sites are optimised for viewing at 1024 x 768 pixels screen
resolution but shall also be usable at resolutions from 800 x 600 upwards.
All of our web sites are designed in compliance with standards and specifications issued/recommended by the World wide Web Consortium (W3C). These standards are set to ensure interoperability across the world wide web and are a key element in ensuring accessibility for all users, including disabled bodies. Subliminal Web Design are very reluctant to design web sites that will not conform to the standards/specifications as set out by the world wide web consortium. There may however be certain circumstances where we will agree to a design that does not conform to the standards and specifications of the world wide web consortium.
Content:
IPR (Intellectual Property Rights) - You agree that you own the intellectual property
rights of any content provided by yourselves to Subliminal Web Design, or that the
owner has given you permission to use the content and will allow
Subliminal Web Design to use it on your behalf.
Once paid for in full, web sites and domains become the property of the client.
However, you agree that only one copy of a web site can be made
available on the World Wide Web and that any stock photography
provided by Subliminal Web Design remains our property and shall not
be used intentionally in any other design or reused outside of
the web site provided by Subliminal Web Design. If provided, any databases
along with any CGI, PERL, PYTHON, JAVASCRIPT and PHP scripts/programs will also remain
the property of Subliminal Web Design. We do not provide scripting/programming as a stand alone service. You
agree not to reproduce, duplicate, copy, sell/resell, or exploit
for any other commercial purposes, any portion of the services or products
provided by Subliminal Web Design.
You agree that the content used in any design by Subliminal Web Design
will not in any way be unlawful, misleading, abusive, offensive,
prejudicial or is likely to expose us to claims, lead us into
prosecution, criticism, disrepute or cause us embarrassment.
Hosting:
We have links with some of the UK's largest server/hosting providers. By selecting only the most reputable providers, Subliminal Web Design can maintain maximum uptime and continued reliable service to our clients. However, no guarantee of service can be made by Subliminal Web Design on behalf of the host. Subliminal Web Design will remain your point of contact for any issues you have with the service and will do everything in its power to resolve problems as swiftly and as professionally as possible.
Logo's, Graphics, Advertisement and stationery design:
Any quotation given for logo design, graphics design, advertisement or stationery design will be valid for a period of 30 days from the date of submission. A 30% deposit will become due upon the acceptance of our quotation and is required to be paid before any agreed work starts. The remaining 70% will become due on completion and acceptance of your design but before the supply of any final formats. Any amounts owed shall be paid by the dates/times stated on the invoices. Late payment may incur a surcharge of 3% per month. Non payment after 28 days have passed will entitle Subliminal Web Design to terminate the contract and/or delete your design from our servers. Any deposits paid shall not be refunded. File formats include: .GIF (Graphic Interchange Format), .JPEG (Joint Photographic Experts Group), .TIFF (Tagged Image File Format), .BMP (Bitmap), .PNG (Portable Network Graphics) and Macromedia/Adobe Shockwave Flash (SWF)
Domain names:
Subliminal Web Design offer a domain registration service subject to
the Nominets Terms
and Conditions. The domain name will
be registered in your name and/or business name through a reputable third
party registration company as selected by us. If you opt for Subliminal Web Design
to carry out the registration, administration rights of the domain
name should remain with us for maintainence purposes whilst full legal ownership remains with
you the owner. You should receive a confirmation of registration from Nominet,
the UK Internet names organization, within 6 months of registration.
A reminder will be sent to you by Subliminal Web Design via e-mail approximately
6 weeks before the domain name is due to expire. For this reason,
it is your responsibility to keep us up to date with your contact
details (including email addresses) to ensure that you receive these notifications. You accept
that Subliminal Web Design will not be held responsible for a missed
registration upgrade of any domain name. It is your responsibility to
send written confirmation of renewal to Subliminal Web Design along with
payment for registration at least 2 weeks before the domain name
expires. Payment and time options will be sent to you with the domain expiry reminder.
Warning: for .com/.net/.org/.info/.biz domains,
if you do not renew the domain during the 40 days after its expiry
date, the domain will enter a period of Redemption. This starts
at 45 days after expiry and ends 75 days after expiry. During
this time the domain may be renewed, however there will be a charge payable to the registration company. At the end of redemption, and following a further
five days, if the domain has still not been renewed, it will become
publicly available for registration. For all other suffixes including ".co.uk", If
you do not renew your domain name before the expiry date, it will
expire and will become available instantly for other members of the public to register.
Invoicing:
Invoices will be published within the client login area of the Subliminal Web Design web site and a notification of the invoice being available will be sent to you via e-mail. Separate invoices are available upon request by post or in electronic PDF format, you will require a copy of Acrobat Reader to open the PDF files. This software is available freely from http://www.adobe.co.uk/ - Maintenance invoices are also published within the client login area and a notification of any such invoice will be sent to you via e-mail. Maintenance invoices are issued at the end of each agreed payment period and should be paid in full within the time specified on the invoice. Late payment of any invoice may attract a fee of 3% of the total amount. Payment may be made by cheque, postal order, bankers draft or Paypal.
Virus protection:
Whilst we carry out regular virus checks on all of our systems and virus check every incoming and outgoing file, we make no warranties that files sent from Subliminal Web Design are free from virus infection and recommend you virus check all files received from us prior to opening or executing.

Subliminal Web Design has limited control over such web sites and their content and/or resources on or after the time of submission, and you acknowledge and agree that Subliminal Web Design is not responsible for the availability of such external web sites, does not endorse and is not responsible or liable for any content, advertising, products, or other materials on or available from such sites or resources.
